23XI Racing and Front Row Motorsports will operate as open teams in the 2025 NASCAR Cup Series following NASCAR's removal of the anticompetitive release requirement from its open agreement.

The teams' lead attorney, Jeffrey Kessler, confirmed they will continue their appeal to the 4th Circuit for an injunction to maintain their chartered team status and avoid potential financial harm.

This development follows both organizations' refusal to sign the 2025 charter agreement or open agreement in September due to a clause preventing legal claims against NASCAR. In response, they filed an antitrust lawsuit against NASCAR and Jim France, alleging anti-competitive practices.
