NASCAR Teams 23XI and Front Row Abandon Injunction Appeal After Rule Changes

23XI Racing and Front Row Motorsports have requested dismissal of their appeal against the preliminary injunction ruling, marking a significant shift in their legal battle with NASCAR.

The teams initially appealed after Judge Frank D. Whitney rejected their request for a preliminary injunction aimed at removing an anticompetitive clause from NASCAR's open and charter agreements. This injunction would have allowed them to continue competing while pursuing their antitrust lawsuit.

Following NASCAR's recent removal of the contested clause from the open agreement, both teams committed to racing next season as open teams, effectively changing the circumstances of the case.

The teams' latest filing states: "Circumstances have changed in the underlying case, removing the need for this appeal and necessitating Appellants to seek new relief from the district court." They've requested voluntary dismissal, acknowledging the proceeding cannot be reinstated later.

Judge Whitney's original ruling left room for the teams to refile the preliminary injunction in District Court, provided they could demonstrate a "likelihood" of irreparable harm. The judge had previously dismissed their claims about potential loss of drivers and sponsors as showing only a "possibility" of irreparable damage.
